Profilemesh Terms of Service
Welcome to Profilemesh. Please read these Terms of Service carefully before you access, register for, purchase, log in to, or otherwise use the service. By accessing or using Profilemesh, you confirm that you have read, understood, and agreed to these Terms, together with any additional rules, policies, notices, or supplemental terms that apply to specific features or transactions.
If you do not agree to these Terms, do not access or use the service.
1. Scope of the Terms
These Terms apply to your access to and use of all products and services that we make available through Profilemesh, including but not limited to:
- the website and public pages;
- registration, login, account management, and identity verification;
- workplace analysis, self analysis, team relationship sandbox, team report, and related analysis or generation features;
- subscription services, points or credit packs, payments, billing, purchase synchronization, and related support services; and
- any other features, pages, interfaces, content, or add-on services that we may release from time to time.
If a specific service is subject to separate rules, promotional terms, checkout disclosures, feature notices, or supplemental agreements, those terms will form part of the agreement between you and us. If there is a conflict, the more specific or more recently published term will control for that specific service.
2. Service Positioning and Eligibility
Profilemesh is an AI-assisted service for workplace scenario analysis, personal pattern observation, team relationship organization, communication strategy support, and related report or visualization generation. The service is intended to provide users with clearer frameworks for observation, reflection, and communication support.
- The service is intended for natural persons with full legal capacity, or lawful entities.
- If you use the service on behalf of an organization, company, team, or other entity, you represent that you have authority to bind that entity to these Terms.
- You are responsible for ensuring that your access to and use of the service is permitted under the laws and regulations applicable to you.
- You may use the service only for lawful, proper, and prudent purposes consistent with these Terms.
3. Account Registration, Login, and Security
Some features may require you to register an account, bind an email address, complete third-party identity verification, or maintain a valid signed-in session. You agree to:
- provide true, accurate, complete, and up-to-date registration and payment information;
- keep your account credentials, verification codes, devices, and login tokens secure;
- remain responsible for activity conducted through your account, except where applicable law provides otherwise; and
- promptly notify us through in-product support or published contact details if you become aware of account theft, suspicious login activity, unauthorized payment activity, or other security issues.
We may take reasonable and necessary measures to verify identity, prevent abuse, block suspicious activity, restrict logins, freeze features, or request supporting materials in order to protect accounts and transactions.
4. Service Availability and Changes
We will use commercially reasonable efforts to provide the service on an ongoing basis. However, you understand that internet services may be affected by upgrades, maintenance, network instability, third-party failures, legal or compliance requirements, system faults, security incidents, or other causes outside our reasonable control.
- We may add, adjust, limit, suspend, discontinue, or remove features, pricing, model capabilities, quotas, page structure, membership benefits, interaction flows, payment processes, or technical architecture.
- We may impose eligibility rules, rate limits, usage limits, geographic restrictions, or account-level restrictions for security, compliance, risk control, cost control, service stability, or product strategy reasons.
- We do not promise that any particular feature will remain available permanently unless we expressly state otherwise in writing.
If a change materially affects existing paid entitlements, we will provide notice through reasonable means such as in-product notices, page updates, billing notices, email, or similar channels where appropriate.
5. Paid Services, Subscriptions, Points, and Billing
Profilemesh may offer both free and paid features, and may use subscriptions, one-time purchases of points or credit packs, or other billing models. The applicable pricing, included entitlements, auto-renewal rules, tax disclosures, billing cycles, and settlement currency are as displayed on the pricing page, checkout page, order page, billing page, or other transaction-related pages.
- Paid features usually become effective after successful payment, but entitlement delivery may be subject to a reasonable delay due to payment callbacks, risk review, purchase synchronization, wallet refresh, or system processing.
- Subscriptions generally renew automatically according to the billing cycle selected at purchase unless you cancel before the next billing date.
- Points, quotas, credit packs, wallet balances, or similar digital entitlements are only usable within the service and do not constitute cash, electronic money, deposits, stored value accounts, or freely transferable property.
- Unless required by law or expressly stated otherwise in writing, points, quotas, and credit packs are non-transferable, non-withdrawable, and non-redeemable for cash.
- You are responsible for maintaining a valid payment method, accurate billing details, and sufficient payment capacity.
If we do not receive payment because your payment method fails, a payment is reversed, refunded, disputed, blocked for risk review, or otherwise not completed, we may suspend, restrict, or terminate related paid entitlements and recover the value of service costs, consumed quotas, or other amounts owed.
6. User Content and License
In connection with your use of the service, you may submit, upload, input, generate, store, or share text, questions, descriptions, team information, relationship information, files, images, prompts, activity records, and other materials. We refer to these materials as "User Content."
- You own or have obtained all rights necessary to provide the User Content.
- Your User Content does not infringe the intellectual property, privacy, publicity, confidentiality, reputation, or other rights of any third party.
- Your User Content does not include material that is unlawful to transmit, store, or process.
- You will not submit sensitive or high-risk information that is clearly unrelated to the service purpose unless the relevant feature specifically requires it and you have a lawful basis to provide it.
As between you and us, you retain any rights you may hold in your User Content, except as otherwise required by law or agreed between the parties. To operate, provide, maintain, improve, secure, support, and troubleshoot the service, you grant us a worldwide, non-exclusive, sublicensable license, revocable to the extent practicable but effective as necessary to deliver the service, to store, reproduce, transmit, process, format, display, analyze, and generate outputs from User Content.
7. AI-Generated Content, Disclaimer, and Risk Notice
This section is important and should be reviewed carefully.
Profilemesh uses AI models, automated analytical logic, and third-party technical infrastructure to generate certain results, summaries, labels, maps, strategic suggestions, relationship observations, and report content. You understand and agree that:
- AI outputs are probabilistic, inferential, and inherently uncertain, and may be incomplete, inaccurate, outdated, one-sided, mistaken, or unsuitable for your specific situation.
- Outputs are provided for reference, inspiration, organization, and decision support only, and do not constitute medical, mental health, psychiatric, legal, financial, securities, tax, investment, employment, hiring, compliance, or other professional advice.
- The service is not a clinical diagnostic tool, emergency response tool, crisis intervention system, or high-risk decision-making system.
- You must not rely on the service as the sole basis for medical decisions, mental health crisis handling, legal disputes, financial decisions, hiring or termination decisions, disciplinary action, discriminatory judgment, or any other decision that could significantly affect a person's rights or interests.
- You are solely responsible for verifying facts, applying human judgment, seeking professional advice where appropriate, and deciding whether or how to rely on any output.
If you are facing a mental health crisis, self-harm risk, urgent medical situation, legal deadline, or any circumstance requiring immediate qualified professional intervention, do not rely on the service as a substitute for appropriate professional or emergency assistance.
8. Acceptable Use Rules
You may not use the service for unlawful, infringing, abusive, dangerous, fraudulent, or harmful conduct.
- No unlawful, harassing, hateful, fraudulent, violent, or rights-infringing content.
- No impersonation, falsified authority, forged transactions, scraping, mass extraction, or automated abuse.
- No attempts to bypass access controls, quotas, or service protections.
- No use of the service to train competing products or build substitute services.
- No malware, phishing content, or other harmful materials.
9. Third-Party Services and External Links
The service may integrate with or depend on third-party products and services such as identity verification providers, payment providers, cloud infrastructure, database services, logging or monitoring services, AI model providers, CDN providers, or security vendors. Those services may be governed by their own terms, privacy policies, refund rules, and operational rules.
10. Intellectual Property
Except for content that belongs to you or a third party under applicable law, all intellectual property rights in and to Profilemesh and its related pages, software, interface design, trademarks, logos, copy, structure, databases, algorithms, model orchestration, code, graphics, audio or video materials, report templates, and related content belong to us or the relevant rights holders.
11. Suspension, Termination, and Breach Handling
We may suspend, restrict, or terminate access where you violate these Terms, create fraud or abuse risk, refuse necessary verification, maintain an outstanding balance, reverse charges, or where the service must be changed or discontinued for legal or operational reasons.
12. Warranty Disclaimer and Limitation of Liability
To the fullest extent permitted by applicable law, the service is provided on an "as is" and "as available" basis. Except where required by law, we disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, availability, continuity, timeliness, reliability, non-infringement, and error-free operation.
To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, goodwill, data, commercial opportunity, or decision-related outcomes arising from or related to your use of or inability to use the service.
13. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless us, our affiliates, partners, personnel, and agents from claims, complaints, investigations, losses, liabilities, costs, and expenses arising out of or related to your User Content, your use of the service, your violation of these Terms, your violation of law, or your infringement of any third-party rights.
14. Privacy and Data Processing
Please review our Privacy Policy to learn how we collect, use, store, share, and protect personal information. The Privacy Policy forms an important part of these Terms.
15. Refunds and Cancellation
Rules relating to subscription cancellation, auto-renewal, points or credit packs, refund eligibility, review timeframes, and refund methods are set out in our Refund Policy, which forms an important part of these Terms.
16. Updates to the Terms
We may update these Terms for legal, regulatory, business, security, product, payment, or other reasonable reasons. Updated versions will be posted on the relevant page and will take effect from the publication date or the effective date stated in the notice.
17. Governing Law and Dispute Resolution
These Terms, and any dispute arising out of or relating to these Terms or the service, are governed by the applicable laws of the operator's principal place of business or place of registration, except to the extent mandatory law provides otherwise.
Before starting formal proceedings, the parties should first attempt to resolve disputes in good faith through discussion. If a dispute cannot be resolved informally, either party may bring the matter before a court with competent jurisdiction in the operator's principal place of business or place of registration, or follow any dispute resolution procedure otherwise stated on an order page, supplemental agreement, or as required by applicable law.
18. Contact Us
If you have questions, comments, or complaints about these Terms, please contact us first at support@profilemesh.com.
19. Miscellaneous
If any provision of these Terms is held invalid, unlawful, or unenforceable, the remaining provisions will remain in effect. Our failure to exercise or delay in exercising any right does not waive that right. Section headings are provided for convenience only and do not affect interpretation.
